Terms of Service

These Terms govern your use of the MarBill mobile application (“the app”, “MarBill”) provided by Too Loud Communications (proprietor: Shobhit Jitendra Johari), GSTIN 24AYVPJ7014J1Z3, registered at 402, Shree Murlidhar Appartment, Opposite Agrasen Bhavan, Surat, Gujarat – 395007, India (“we”, “us”). By creating an account or using the app, you agree to these Terms.
1. The service
MarBill is a mobile billing and inventory application designed for traders of marble, granite, and natural-stone products in India. It helps you record varieties of stock measured in square feet, create quotations and tax invoices (with GST), maintain a party ledger, and share PDFs via WhatsApp and other share targets.
MarBill is a tool. It is not a substitute for a Chartered Accountant, tax filing software, or legal compliance counsel. You remain solely responsible for the accuracy of the data you enter and for your tax filings.
2. Eligibility & account
You must be 18 or older and authorised to bind a business to these Terms. You sign in via your mobile phone using a one-time password sent by Firebase Authentication. Keep your phone secure — anyone with access to your number can sign in.
You must provide accurate business information (name, GSTIN, state) so that generated invoices comply with applicable law.
3. Permitted use
You may use MarBill for the lawful billing and inventory needs of your business. You may not:
- Use MarBill to issue fraudulent invoices, evade tax, or facilitate unlawful trade.
- Attempt to access another tenant's data, reverse-engineer the app or API, or interfere with service availability.
- Resell, sublicense, or white-label MarBill without our written permission.
We may suspend or terminate accounts that violate this section.
4. GST and compliance
- MarBill performs deterministic arithmetic for sq.ft, CGST, SGST, IGST, round-off, and totals. These calculations follow the rules you configure in Settings (your state, the variety's GST %).
- It remains your responsibility to (a) verify that the configured GST % and HSN for each variety are correct, (b) ensure your invoice numbering complies with applicable regulations, and (c) file your GST returns on time.
- MarBill v1 issues plain GST invoices. It does not generate e-invoice IRN/QR or e-way bills. If your business is required to generate these (e.g. aggregate turnover above ₹5 crore for e-invoicing, or consignments above ₹50,000 for e-way bill), you must use the appropriate Government / GSP system in addition. Support for these is planned for a future release.
5. Your content & data ownership
You own the business data you enter in MarBill (parties, varieties, invoices, ledger). We process it on your behalf solely to provide the service. You can export your data as CSV from More → Export CSV backup.
We will not access your data except (a) to operate the service, (b) to respond to a documented support request from you, or (c) where required by law.
6. Pricing & subscriptions
MarBill v1 may be made available with a free trial, paid subscription tiers, or both. Pricing, billing cycles, and refund policy will be displayed in-app and on marbill.in/pricing before you are charged. Subscription processing is handled by external payment providers (e.g. App Store, Play Store, Razorpay) under their own terms.
7. Availability & changes
We aim for high availability but do not offer a guaranteed uptime SLA in v1. We may, with reasonable notice where practical:
- Update, modify, or remove features.
- Perform maintenance that briefly interrupts service.
- Change these Terms (see §11).
We will not delete your business data without your action or proper notice.
8. Disclaimers
MarBill is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app is error-free or that your tax filings will be accepted by authorities solely because they were generated by MarBill.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to your use of MarBill is limited to the amount you paid us for the service in the 12 months immediately preceding the event giving rise to the claim, or ₹10,000, whichever is greater. We are not liable for indirect, incidental, or consequential damages including lost profits, lost data, or business interruption.
10. Termination
You may stop using MarBill and delete your account at any time via More → Settings → Delete my account. We may terminate or suspend your account for material breach of these Terms with notice where reasonable. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, governing law) will survive.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app on next launch and by email. Continued use of the app after the change constitutes acceptance. If you do not agree, you may delete your account.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. Courts in Surat, Gujarat have exclusive jurisdiction over any dispute, subject to applicable mandatory consumer-protection law.
